Terms of Service – Whisper AI Transcription

1. Service Description

We provide a web application to upload audio and obtain transcripts. Audio is stored in AWS S3, processed via AssemblyAI, and account/app data is managed through Firebase Realtime Database. We strive for high accuracy but do not guarantee error-free results.

2. Your Content & License

You retain ownership of your audio and transcripts. You grant us and our processors a limited, non-exclusive license to host, process, and transmit your content solely to provide the service and support, and to comply with law. Do not upload content you lack rights to use or that violates law or third-party rights.

3. Acceptable Use

You will not: (a) use the service for unlawful, harmful, or infringing purposes; (b) attempt to access others' data; (c) interfere with or disrupt the service; or (d) circumvent security or usage limits.

4. Subscriptions, Billing & Refunds

Some features may require a paid plan. Billing is handled by third-party payment providers or app stores; renewals, cancellations, and refunds follow their policies. We may change pricing with notice for future periods.

5. Privacy & Data Security

Our Privacy Policy describes how we handle personal data and content (including use of AssemblyAI, AWS S3, and Firebase). You acknowledge that no system is completely secure and agree to use the service at your own risk.

6. Availability & Changes

The service may change, be updated, or become temporarily unavailable. We may modify or discontinue features with reasonable notice where practical.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant accuracy, completeness, or reliability of transcripts or continuous availability.

8. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates, officers, employees, and providers are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, arising from or related to your use of the service. Our total liability for any claim will not exceed the amounts you paid for the service during the 3 months preceding the claim.

9. Indemnity

You will defend and indemnify us against claims arising from your content or your breach of these Terms or applicable law.

10. Termination

You may stop using the service at any time. We may suspend or terminate access for violations, security risks, non-payment, or legal reasons. Upon termination, we may delete your content after a reasonable period unless required to retain it by law.

11. Governing Law & Disputes

Unless a different law is mandatorily applicable, these Terms are governed by the laws of Estonia (without regard to conflict-of-law rules). Courts of competent jurisdiction in Estonia shall have jurisdiction, subject to any non-waivable consumer rights where you reside.

12. Changes to Terms

We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance.
